The Shake process


1 Agree underlying terms, 2 Submit three proposals, 3 Shake, Settlement reached at mid-point of overlap

How it works

  • Party A creates a Shake – names it, sets a timescale and uploads proposed settlement agreement. 
  • Shake invites Party B to sign-up. (No commitment made at this point.)
  • Party B can accept the proposed terms and continue or decline them and end the Shake.
  • Each party submits three proposals for settlement (Claimant from high to low; Defendant from low to high). 
  • Shake assesses each pair of proposals in turn. If there is overlap, settlement is declared at the midpoint of the overlap. Otherwise, the next pair of proposals is assessed.
  • If settlement is reached, Shake confirms the settlement terms and amount to the parties.
  • If settlement is not reached, the parties continue as before.  They can use Shake again at any point.
  • Either party can end the Shake at any time without detriment before proposals are submitted.

I have been invited to a Shake. What's in it for me and my client?

Shake provides a low-cost route to settlement, which is especially beneficial where costs / fees are fixed, or where the likely costs of mediation or litigation are disproportionate to the value of the claim. Shake also reduces time to settlement, and therefore to receipt of client fees.


Will using Shake impact the route to mediation or litigation?
No. Neither party discloses any information to the other unless and until settlement is reached, so other routes to resolution are not impacted.


How much will it cost?
Shake is no settle, no fee.  In the event of settlement, your fee will depend on the value of the dispute, with a cap of £250 + VAT.


How long will it take?
Shake defaults to a two-week period from the date of invitation, but parties can agree anything up to three months.

Does Shake benefit one party more than the other?
No. Either party can create the Shake and invite the other. The originating party uploads the terms, but these should be agreed by the parties in advance outside the Shake platform. The receiving party is free to decline the terms. Neither party sees any of the other party's information at any time.


How are the costs of using Shake allocated in the event of settlement?
If costs are included in settlement, parties should factor the cost of the Shake into their proposals. If costs are excluded, the cost of using Shake should be included in the subsequent costs considerations (which can also be settled using Shake).


Is Shake owned by a law firm?
No. Shake is independent and impartial. It is provided by AXM Studios Ltd, a private limited company with no law firm shareholding.
